Legal Question in Family Law in Texas

child support payments

I have 2 children ages 13 and 15. There father has paid child support for 11 years. Our son, age 13, is going to live with him now after 11 yrs. of seperation. Our daughter will remain with me.He says he dosen't have to pay child support now and will not cover them on medical insurance, which I have paid as court ordered for the last 11 years.I want him to start paying medical as I have always paid and I want him to still have to pay support for our daughter. Please note he has never assisted or helped with the children and has never paid 1/2 medical as ordered by the court. Now he will have one child and I the other and I will continue to pay for all medical expences. He has not been with the children for 11 years and has never had the support raised or paid any bills. Is there anything I can do?

Re: child support payments

1. You can file contempt on him for not doing the things the judge ordered him to do in the last document signed by the Judge.

You will need a certified copy of the last document signed by a Judge, perhaps it is the Final Decree of Divorce, without discussing your case with you in person, I'm only guessing.

2. Just because each of you has one child, does not eliminate child support payments. Normally the court looks at what each parent would pay for one child. If one of you makes $200,000/year and the other parent makes $25,000/year, you can easily see that the parent making $200,000/year would pay the other parent some child support.

You really need an attorney.

Please find one in your area to assist you.

If you don't know any, you can try to use Lone Star Legal (free) or call the State Bar of Texas in Austin for potential attorneys.

Good luck!
