Child support payments termination
I am a non-custodial parent who has been paying child support for about 13 years. The court order was from Texas. My child will turn 18 in 2 days, at which time my obligation to pay child support ends. I have my payments deducted automatically from my paycheck. Must I notify the Attorney General's office or child support division of his pending birthday to ensure payments stop? Or, will they stop deducting it without contact? I just want to make certain that office knows my obligation has been satisfied. Thank you.

I would like to tell you that our Attorney General's Office would automatically flag the file for review once the child turns 18. However I have no confidence that this will occur.
Your obligation may also continue through the month following the end of the school year, depending upon the drafting of your decree, and depending upon the end of that particular school's year. In other words, you may owe for June if that's when the graduation is, assuming your child graduates this year. Here's the bad news - if high school isn't finished, your child support may be continued. Lots of facts need to be known to determine that.
I believe you must contact the Texas A.G., notify them of the child's birthday, and any other facts that would end the obligation. Then the Texas A.G. can issue a termination of your wage withholding. Notice I said "can" - be prepared to get the "run around" and be put on hold many times. It is a frustrating experience even for attorneys, but do not give up.
