child support not received

My wife is owed back child support. I subsidized the lack of child support with a second job. If we get divorced and she starts receiving the support owed can I recoup half of the money???

Bottom line answer - probably not!

Don't expect to receive anything.

It's going to cost you extra legal fees to argue and prove that you should be reimbursed for $$ you put into the support of her children.

The judicial system assumes that you are an adult and no one forced you to spend the $$.

Also, your spouse has to have $$ in order to get $$. If she's broke, how are you going to get any $$????

No.

Under a divorce you get your share of community assets and community debts.

If you can show that your separate property was depleted to benefit the community property, you might have a reimbursement claim against the community estate.
