Child Support

I recently married a man with 3 children, to whom (1)child recieves court ordered child support and the others were self initiated. I was informed that the mother in the case that was court ordered is requesting modifications to the amount originally awarded. Will my personal income be effected by this modification, considering together we have 5 children ? If so what is the maximun amount, considering debt and income?

Your income is not considered in setting your husband's child support.

Likewise, your debts are not considered either.

Neither are the additional number of kids that have joined his household that are not his biological kids.

You can go to the Texas AG website and look at how they determine c.s.

You can also go to the Texas Family Code available on-line and read the code for yourself.

Basically, you take gross income and deduct social security and federal income taxes (based on what the State of Texas allows to be deducted) and that's the net income. Then he gets a deduction for what he pays for the kid's health insurance.

If he has 3 kids with the same person, he is looking at 30% of his net income going for c.s. to his ex-wife.
