My spouse has children from a previous relationship. Child support has been coming out of his pay for the last 6 mths and he just had a court date on yesterday and was advised that he had to bring in $3800 by March 2009 or face jailtime. He asked for a blood test and was told by the judge that he cant and he is leagally bound to these children.. 1. Can he fight this. 2. Can he get a blood test. 3. can he give up his rights....

He might be able to fight the ruling but he needs an attorney and he needs do get one immediately.

The parentage of the children was already decided back when the original order was issued. It's too late to contest it now.

No, he can't give up his rights unless there is someone who will adopt these children in his place.
