Child Support

State of Texas-If there has been no legal separation or divorce agreement from the court, can child support be back ordered through the court. There is nothing showing legal separation, just the parents living in separate residences.

Technically, there is no such thing as legal separation in Texas. And, yes - the fact that the parents are living in separate residences does not negate the responsibility for child support. If you owe it, you better start making arrangements to pay something. Something is better than nothing and makes the arrearage easier to accomodate.

I definately recommend that you have proof - like a cancelled check or money order copy to show that you have been providing monthly support.

It's amazing how many people develop amnesia during a divorce.

Never give the other parent CASH!

Paperwork is the non-custodial parent's best friend.

If you buy the kid clothes, school supplies, food, entertainment, etc. be sure to keep a copy of all receipts!

KEEP ALL OF YOUR RECEIPTS!

It is your burden to prove that you have been supporting your child.
