Child Support from Step Parent

I am a step parent of 3 children living with my husband. The children are 16 (Twins) and 14. They now want to live with their mother who has filed a custody change request.

As the step parent, my income is substancially higher than hers and my husbands. If granted custody will she have rights to my income for child support?

Currently I am the sole financial support for these children including medical benefits.

Re: Child Support from Step Parent

Your income, as the step parent, should not be used in determining how much child support your husband should have to pay his ex-wife. However, if your husband is unemployed and stays at home, you may, as a practical matter be ordered to pay whatever child support is taxed.
