Child support

Is it against Texas law to pay child support to someone if the child is living with someone else and not the person the child is supposed to be living with? My fiance' pays child support to his soon to be ex and their child doesn't live with her, the child lives with the ex's mother and grandmother? Also my ex doesn't get to have his son on weekends like he is supposed to, but, he is afraid to fight it due to barriers that he might hit along the way and what it could do to his son. What do we do?

The child support goes to the person named in the order. If grandma is taking care of the child, she could sue the mother for child support or to receive the payments directly. If your husband doesn't want to do what is necessary to see his son - well, that's his problem.
