Legal Question in Family Law in Texas

Child support and Visitaion...

The father of my son is very irresponsible and has really bad drug addicted friends.

I would do the whole child support thing but I don't want him to be able to take our son places without me. He will take him to his friend's houses to show him off and not even bother to take care of him. I just know it. Our son is a special needs child. He can't be around cigarette smoke, he has to stay in sterile environments, and has to be given meds constantly. I know his father will forget and endanger his life but how do I get that to hold up in court? How do I prove that he's not responsible enough to care for our son by himself?

He does have a charge pending. Can I use that?

Re: Child support and Visitaion...

You accomplish this by confiding in your attorney. You are describing a situation which could be very harmful your child, and possibly has been in the past. An attorney understands the type of evidence needed to convince a judge to impose restrictions, supervision and limits on visitation, when warranted. If you try to accomplish this on your own, it is going to be difficult, at best. Additionally, child support is not tied to visitation. A parent is financially responsible for the child and has to pay support according to the guidelines.
