Legal Question in Family Law in Texas
Child Support Visitation
My wife is in the military and we are stationed in NC. I am unable to visit (in TX) all the times allowed according to the child support order, but when i do visit my ex will not allow us to see my 2 children. She will not even give me the information of their schools or home adress. Is this contempt of court if she is ordered to do so and what can i do about it? Also, can she take away the visitation rights if i cannot visit regulary because my spuse is in the military and constintly deployed?

Re: Child Support Visitation
The response given is general in nature as specific legal advice can really only be given after a full consultation and a sharing of all specific, relevant facts. However, generally, I would respond:
Neither parent can withhold visitation/access to the children without a court order -- even if the noncustodial parent is not paying their child support. Your specific order (decree) will determine your rights regarding the kids' school information. Most decrees provide that the non-custodial parent has a right to that information.
Good luck with the visitation. If I can be of any assistance to you, please give me a call or send me an e-mail.
