Legal Question in Family Law in Texas
Child support - his new wife not working
Hello, I went to court in 1997 for child support and have not been back since. The dad was ordered to pay 500/month. In Jan of this year my job xferred me to TX from CA - the dad said I could go if he lowers the support to 250. due to lower cost of living. I had to go so I said ok and signed a piece of paper. The dad has 2 newer kids and his wife is a stay at home mom so he can't afford my son -does it count that he has 2 other kids to support if she doesn't work? Can he lower the support because he let me move? Thank you for your help, I appreciate it.

Re: Child support - his new wife not working
Your foreign decree can be registered and enforced here in Texas. This may or may not be an issue you want to address in a court of law. Did the original order require you to remain in California? If so, you may be stirring a pot best left alone. Your question raises the issue of whether or not you help yourself, by exercising your rights. Take your entire file, and consult with an attorney on the best course of action to pursue.
