child support

Hello,

I have an 11 year old child. This is my only child. I was never married to her father and I have a court order for child support from 1998, which he always pays monthly. Since 1998, the dad has married and had an add'l. 3 children with his wife. She quit her job when she got pregnant with the 1st child and has not returned to work. My question is this - if I take him back to increase the child support since it has been 10 years, will the fact that he has 3 other children to fully support come into play even though the mother is not contributing financially - will she be responsible at all for some of the costs to raise the other 3 or will my child get less so she can be a stay at home mom?

Re: child support

The new children will be factored into the formula to determine if child support should be increased. Whether or not the wife works is of no consequence, as it does not affect the guidelines. If in the past 10 years is income has risen sufficiently, then the child support may increase anyway.
