Child Support

About 2yrs (1998) ago I applied & received court ordered child support(CS) for $400/mth. Weeks later I was informed that a request was made to have the CS reduced;now it is time to have the case reviewed. My problem is, I have been given documents indicating my son's father as part owner of a trucking company & gas station (Shell).In 1998 he applied for & received a small business loan for the amount of over $300,000.00. By the end of the year he had completely moved to Calif. In 1999 he and his wife filed for bankruptcy (Before being sued by lending institute and the lean holder of gas station property). Question: Although this request may seem trivial to other but do you think that it would benefit me to seek an attorney in order to protect the finacial interest of my child?

Yes, I do. Although bankruptcy is commonly regarded as the financial end of the line, in fact it can be beneficial because bankruptcy wipes out or reduces other debt, thus increasing the amount of money available to the debtor/obligor. Also, if your child support is $400 per month for one child, this means that the obligor is grossing, or is capable of grossing, only somewhere around $30,000 per annum. Sounds to me that in the recent past, the SBA thought enough of his money-making potential to lend him $300,000 - this may be worth looking into.
