Legal Question in Family Law in Texas

child support/child modification

This summer my daughter attempted to start a relationship with her father after 12 yrs. She went to live with him. He modified papers to read he did not owe any back child support or future support with the verbal agreement he would assume all expenses incl. car, clothes and college to make up for not helping all these years. I agreed. Within two weeks the verbal abuse began and within the third month she attempted suicide and hit her in the eye causing serious bruising/swelling. She was placed in a treatment center for depression and safty until CPS reviewed situation. Her father agreed to release her to me and stated he would help with further treatment. I have requested financial assistance on several occasions with no follow-through. So I am responsible for everything again. I want to persue with a breach of agreement and continue on to collect back child support, medical responsiblities(past, present, and future)and seek child support for the future. My daughter is also diabetic so the medical bills are never-ending. Do you think I am within my rights to claim a breach in modification agreement and if so ,can I seek back child support?

Re: child support/child modification

I wonder if this "modification agreement" was an Order issued by the Court. That's the only way to pay child support. If the modification was not a court order, then you can still go after the past due child support. Good Luck!
