Child Support-Modifacation

I've been divorced seince 92' I have a 17 y/o child who has had child support garnished from his( The child's father) wages since then need to know if my child fails a grade like this year & can't gradute next year does my child support still go on? I heard that he can't stop the garnishment till we go back to court when she gradutes from high school need to know the Texas State Law because i am disabled I can't afford a lawyer my child does not work she has mental problems from not seeing her father but once a year although he does have visitaion which he does not keep. Just Need to know about Child support Garnishment when does it stop???

Under the usual and customary terms of a support order, child support continues until age 18 or until the child graduates from high school, whichever occurs last. So if your daughter is still enrolled in school at age 18, child support continues until the month after the month she graduates. A review of your decree should state this contingency. If it does not, your child may still be eligible for continued support. This would require a motion to modify. If your ex does not pay after age 18 and the decree/order states he should, you might talk to the attorney general if you cannot afford a private attorney.
