Legal Question in Family Law in Texas

Child support-multiple children with different mothers

I'm pregnant from a man that has one biological child from another woman plus has says that he takes care of a second child that she had from another man. He says that his name is not on that child's birth certificate but he carries his last name. He says that if I take him to court for child support I will get little help because he supports these other two children. Will the court allow him to neglect the biological child that I have from him so he can support some other man's child? He is not married to her and they do not live together either. Also can I request that he not have visitation time with my son away from my home until he is over 1 year old?

Re: Child support-multiple children with different mothers

The policy of the State of Texas is that both parents are obligated to support their children.

He would normally be ordered to pay 20% of his net income as net income is defined by the State of Texas -- you can read about it in the Texas Family code -- available on line and free). His net income will NOT be the amount on his paycheck -- it will be what the State of Texas as determined to be "net income". For each child that he is ordered to support, he gets a reduction in the percentage stated above. He will also be ordered to carry health insurance on the child.
