Child Visitation for Birthday

My court order states the other parent must pick up child from residence for birthdays. However, we meet at a central meeting spot for exchanges. Will I be held in any kind of attempt if I do not show up to the central meeting spot on her 4th birthday, which this is when standard possesion starts.

Without seeing your order there is no way to sure of what it says, but birthdays are often treated differently than regular visitation. Normally you will not be held in "contempt" if you do what the order says.

If you had an attorney when the order was written, call his or her office and see if they will answer your question.

I agree with Ms. Bushman that it is unlikely you would be held in contempt.

HOWEVER, if this ends up in front of the judge and the other parent establishes that this had been a standard, expected arrangement, and you did not advise the other parent of the change, you will not look good. This is the child's birthday, and disappointing the child and causing disruption will cause the judge to question your intentions regarding the best welfare of the child.
