Legal Question in Family Law in Texas

Child Visitation & Custody

I have child support and visitation already set- up with for my daughter. Her mom does not follow the visitation order by allowing me to see my daughter, I have her in my custody now, but it has been two years since I have seen her, and before that two years. I'm behind on support but I'm still paying. I'm supposed to return my daughter to her mother on the 27th of this month and I dont want to because I don't want to wait another two years to see her again. I want to file contempt of court on her mom who lives in Houston, I'm in Dallas. I spoke to a lawyer that said if I file on her now I will have to do it where the child has lived at for six months. I can't drive back and forth to Houston right now with my job. Can I enroll her in school down here and file on her and go to court down here, for contempt and to get to be the custodial parent. Is there any chance of me getting in trouble, or would she have to take me to court to get her back. She has and will not let us have a relationship, because she is still mad over the break up and that was six years ago. My daughter is nine and we have joint custody but her mom is the primary. Thanks for the advice Worried Dad

Violating the court order by keeping your child in Dallas won't help your case. You'll need an attorney anyway, so get one now in Houston and they'll be able to tell you your chances of getting the changes you want.

You will have to file your motion for enforcement and contempt in Houston. Find an attorney there. Contact me by email if you want a recommendation.
