Legal Question in Family Law in Texas
Child visitation
My ex has normal visitation rights, but rarely visits our daughter. We live in Ohio he lives in Texas. He has been here 2 times in 3 years to see her. He rarely calls her. We went to Tx in July so I let him know so he could spend a few days with her. He wanted her for the rest of the summer out of the blue. He did not end up seeing her since I would not let her do that. He did not do like the divorce papers said. He was supposed to pick her up at our house on June 15 for his time. He said he will start taking her on all his holidays and such, but we haven't heard from him since his temper tantrum in July in Texas. Now my husband is trying to take time off for the holidays, and we don't know if he is going to try to get her or not. You can't just ask him because he lies and you can't count on what he'll say. Do we have to get a lawyer to try to change visitation, or what do we do? we can't make any arrangements now it seems like, because if we do and he wants her, then we will be breaking the divorce papers. It just doesn't seem fair for him just to pop in and out of her life and us having to arrange everything around his unstable mind. Thank you very much.

Re: Child visitation
You're right. It isn't fair. You can protect yourself from this by getting the order changed to limited, supervised visitaton by a court-ordered intermediary (they are expensive - he pays) and require 30 days notice. If the original order is in TX, you can change it to OH. This is not normal, usual stuff. A lawyer can help you. Good Luck.
