Legal Question in Family Law in Texas

Child 13 year wants to live w/ father

My daughter is only 12 years old but her father (non-custodial parent) told her when she is 13 years old she will be able to decide if she wants to live with him or myself (mother). Her father and I have never been married & he lives in MN & I in TX. Child support papers state, ''Reasonable Visitation'' Can she make the decision at age 13 of who she wants to live w/?

Actually in a custody dispute, the judge will consider the preferences of a 12 year old (this is the earliest age the child can file a preference). It is not the only factor, but if reasonable and in her best interests, then the judge will consider it.
