Legal Question in Family Law in Texas
My children both need braces (2 ortho opinions). I have good health/dental coverage thru my employer, and my Ex pays for our kids' portion thru child support pmts. Ortho gives family discount if both kids get braces at same time, and would direct-bill each parent 50%, or for 1 child each, since they cost the same. However, Ex wants me to make both down pmts of $500 & pay monthly fees of $99 each, and then wants to repay me once I submit receipts to him. I can pay for one child up front, but not both. Ex has track record of dragging out medical/RX repayments to me for over a year just for small RX bills. Divorce decree states we are both 50% responsible for children's health/dental. He refuses to pay his half directly to the ortho, and he has the money. Do I have any recourse, or way to get him to pay his portion directly to ortho?

He just says he refuses to pay directly. The provider has never billed him. I'd go ahead and sign up for the ortho to direct bill each of you for 50%, then, if he doesn't pay, sue him to enforce the decree.
Be certain that you have proof that you let him know about the ortho treatment and payment plans, and that you fully involved him in every step. Certified mail to him of the cost and the direct bill options, with a letter saying you are going to move forward with the direct bill option would be great to have.
