Legal Question in Family Law in Texas

Children Custody

If we have 4 children is it best or a must that my husband keep 2 and I keep 2 even though my husband does not want any, and can he claim when we go to court that I am keeping all the children from him?

Re: Children Custody

Generally speaking the courts like the kids to stay together, especially when they are close. However, it they don't get along then the judge can decide on a case-by-case basis.

You cannot make him take any of the children if he does not want them.

Children over 12 can sign a statement stating what parent they would like to live with primarily. However, it is not binding on the Judge.
