do visitations for children under 3 different than the older ones? Is there a law to stop from live in girlfriend of the father from calling herself 'mommy' to my child? if not what can I do?

Answer to first part - depends. The Standard Possession Order found in the Texas Family Code states that it is presumed to apply to children 3 and older. However, a number of courts apply it to children under 3. Once children get even older, like teenagers, visitation may differ even more.

Regarding the girlfriend calling herself "mommy", that would have to be addressed by a specific court injunction. I wouldn't bank on such an order. Most courts don't micro manage post divorce that much. Now if you are still married and this a temporary orders, courts will tend to issue more strict orders about girlfriends/boyfriends being around children.
