Legal Question in Family Law in Texas
I have two children 11 & 9. My ex husband is an alcoholic and drug user. He has joint custody. He has 2 DWI's. He is currently on probation for 1 DWI and got a possesion charge while on probation. Friday 3/18/11 he received a PI and the police said he was on some kind of pills. My children were with him and his family at a restraunt. His sister's friend, which is a police officer called the cops on him. He became violent and the police arrested him. I do not want my children around this anymore. My son has become very angry and has acted out a couple of times. CPS told me until he physically harmed them I could do nothing. What would you suggest?

You need to file an emergency petition to modify the current visitation provisions. I would suggest that he be limited to limited supervised access through the S.A.F.E. Program.
