Legal Question in Family Law in Texas

My children do not want to go to my ex husbands (their father) home on his visitation weekends. He is living with a woman that they are afraid of and have had MANY issues with in the past. Is there anything I can do, legally to assure their safety or grant their wishes to not go back? They are 13 and 10. He has recently done a few things to cause them to distrust him - but, nothing more than ugly words. He has been a good father - if he was alone and not living with his current GF, they would go all the time.

The situation you describe comes up frequently.

You couldn ask the Court to amend your order (terms and conditions of visitation), but it doesn't sound like you have a strong case. The litigation would be very expensive.

If you could get a mental health professional to testify that it's HARMFUL to the children for them to spend time around "stepmom," it could make a difference.
