i am just wondering if it is legal for my exhusband to allow my 3 yr old daughter to share a room with an 8 yr old boy who is not kin to her

It is not per se illegal. It may or may not be inappropriate, depending upon the circumstances. If you have a specific objection, based upon specific facts, you might retain an attorney to first try to negotiate a compromise.
