Legal Question in Family Law in Texas

Children live in another state

My children live in another state with

their mother. The court ordered us

each to pay our own one way for the

girls. I want to fly the girls home for

a three day weekend and I scheduled

them to fly out after 6pm. Since my

visitation is from 6pm on Friday to

Monday at 6pm because of a holiday.

Their mother got them a flight home

for 7am monday morning. Can I

make her get a later flight? I dont

mind them leaving in the early

afternoon so they will get home in

time for a school night. But she is

doing this to just be mean.

Unfortunately the court papers do

not go over this. Please help

Without a specific direction in the order, and with her having the option of making return flight arrangements, the real problem you face is how do you make her do that? It is unlikely that you can hire a lawyer, file a petition, serve her and get it heard before this Friday. You might prevail in court, if you were willing to pay the extra fare (if any), but you don't have enough time to get in front of a judge. If you can't negotiate your way into a better return flight, then you are just stuck. You should start planning now for Thanksgiving and Christmas breaks.
