Legal Question in Family Law in Texas

My ex has my children in another state, where does custody need to be fought?

My ex-boyfriend and I had a verbal agreement (yes I now realize EVERYTHING needs to be in writting with a judges signature) to let him see our boys, ages 1.5 and almost 3 for 3 months, he is now telling me after this 3 months is over I won't get my children back. No court orders have been filed yet. I live in Texas as have the boys for the entirety of thier lives minus these 3 months. If he files for custody first, doesn't he have to file in Texas since the children are still Texas residents? They are currently in Wisconsin. The father has a criminal background, not pertaining to me or the children. Does is look bad on my behalf i was allowing him to see the children or bad on his behalf that he is now withholding the children?
