Legal Question in Family Law in Texas

can not take children for visitation

Legally where do I stand as primary caretaker if I am unable to take my children to meet their father for visitation because of hardships, such as financial situations or car trouble. And I am unable to get a friend to help. Does the law allow for this?

Re: can not take children for visitation

The law recognizes an 'inability' to comply with a court order. It is important however, that you give your ex as much notice as possible, and that you document the notice. It is also important that you document the circumstances that prevent you from complying -- including witness statements, bank balance on that date, etc. You should always give your ex the option of picking up the children.

Then you need to reach a written agreement with your ex, or get a court hearing to resolve this for the future so that there is not a threat of contempt.
