Re: childrens age

Once a child is 12 years old he or she can make a written Preference indicating which parent he or she would prefer to live with. Then, assuming the other parent is not in agreement with the change, the Preference has to be filed with the Court as part of a modification of custody. Just because the child expresses a preference does not automatically mean custody is going to change. You need a good family law attorney to help you with this.

The age in Texas for a child to express a choice is 12. You would need to file a modification seeking a change of custody and seek tempoary orders to that effect based on the child's choice. I have handled many of these cases over my career and can assist you if you live in the general Houston area. If you are interested in visiting in greater detail about this process, feel free to contact me directly.
