The grandparents can indeed petition the court for custody or could even petition the court to terminate your parental rights. Your biggest hurdle will be to explain your 8 month absence to the court. I strongly advise you to seek legal counsel. This is not a situation in which you should represent yourself.

Re: Can my childrens paternal grandparents get custody?
My concern for you would be explaining why you were absent for eight months. If you have a good explanation, I would say that you have a good chance of prevailing. The overiding issue will be what is in the best interest of the child. I strongly recommend that you retain legal assistance for your case. Call me if you are in north Texas. While the grantparents have standing to sue, you should be able to regain custody after a recent US Supreme Court case limited grandparents rights in this regard. THe key issue is explaining your absence and having a good care plan. If you are in the Austin/ San Antonio area please let us help.
