Children's Rights in Divorce

I am would like to know, in Texas, what is the age a child can be to decide which parent they may choose to reside with. I also want to know, what are the terms associated with such a decision, such as, a home evaluation, adult evaluation, child evaluation, and/or geographic location requirements. Thank you.

You can read the Texas Family Code that is available on-line. Go to any search engine and type in Texas Family Code. It will tell you more than you ever wanted to know!

In Texas, after a child turns 12 he/she can request what parent they want to live with. However, it is not binding on the Judge. It is one of the factors the Judge will consider in determining where the child lives.
