If my childs father is not on the birth certificate but she has his last name does he have any legal rights to her in the state of Texas?

Yes, once he establishes his rights in a courtroom. He has the right to file a suit for paternity, and a suit affecting parent-child relationship. The court will then either consider your agreement as to the child; or the evidence at trial; and render a decision that addresses issues of conservatorship, possession, access and support.
