my child's guardian upon my death

My second husband did not adopt my children. I have one child still under 18 and we are wondering if he would automatically be designated her guardian upon my death or if I need to specifically stipulate that in a document? Her biological father is nowhere to be found. If so, which document do I need to sign?

Guardianship is a legal designation requiring application and a court order. It is not simply filing a form. If you should die tomorrow, your child under 18 would be looking for his/her natural father. Your husband has no legal right to the child. Your husband might be chosen as a foster home for the child - maybe not.
