if a childs mom is dead and their father is un fit to take care of the child how old ould the child have to be to choose where they live

A child can't choose where to live. Only a judge can do that.. However if the child is 12 or over, the court will consider testimony from the child in a divorce case or suit affecting the parent child relationship.
