Legal Question in Family Law in Texas

My childs rights

My daughter is 12 and going to be 13 next June. Her dad is in Mexico and has not visited her regularly since we got divorced. My daughter and I are in TX and I want to know what are her rights. She wants to be here at home for her birthday but he insists she be with him unless there is a change in his health which he will let us know. Does she have any rights or say so in what she does and when she visits? Thank you
