Re: Childs wellbeing

As the child's father he has the right to petition the court for conservatorship. It is impossible to speculate as to the outcome, although from your description he is in a good position. The prior history and proceedings, as well as his current living and working situation will bear on the court's decision. He needs to hire a lawyer to prepare a petition (either original or modification, depending upon the current court orders).

If the parents were never married, the man needs to file paternity papers in order to be legally recognized as his father. Then he can get custody too.

The information given below is general in nature only as I do not know the specifics of the particular case about which you inquire. These general principles may or may not apply in this specific case because of facts of which I am not aware. I hope this general information is, nonetheless, helpful.

Your son, assuming he has already been recognized as the father, could petition the court for custody. If he has not yet been adjudicated to be the father, he could file for an adjudication of paternity and custody.

Good luck resolving this matter. If I can be of assistance to you, please feel free to e-mail or call.
