Legal Question in Family Law in Texas

childsupport

My ex-husband & I have 3 children, ages 19, 18, & 13. My 19 year old attends college at SHSU and my 18 year old is at Kingwood College. Both still supported by me full time. My ex husband has not paid any childsupport and says he will not pay any support to me for them. How long can I still recieve child support for my 3 children and also where can I go to recieve legal help that doesn't cost me a fortune? I am not on any kind of public assistance, but cannot afford to pay much.

Re: childsupport

I presume you have a divorce decree that states the child support obligation. That obligation usually ends at age 18 - unless there is some special provision for continuing for college - usually not. If he has not paid you child support for 19 years for any of the children -- well, that's a different matter. You can still collect child support arrears for the 19 and 18 years old, but you can't put him in jail. Now, for the 13 year old, he can be held in contempt and jailed for failure to pay child support. That doesn't happen very often and I don't know if your EX has been hoarding the child support payments that he didn't make. That doesn't happen very often either. So, I doubt that he has a bunch of cash hidden somewhere waiting for you to take him to court. So, if everything went well, you could receive an increase in the monthly child support amount to cover the current, the delinquent and the arrears, but it's usually not enought to kill the golden goose.
