Legal Question in Family Law in Texas

Choice of Visitation by a Teenager

My husband has a seventeen year old daughter from a pervious marriage. My husbands divorce allows for visitation, but due to a recent disagreement between my husband and his daughter she feels that she does not have to come over anymore. My husband is really having problems with his exwife in which the child is being brought into. Is there a way we can make his daughter follow the custody agreement without going back to court? Can a police officer go with us to take custody of his daughter for the assigned times? I know that they will work through this if he could just talk to her without her mother right beside her. What should we do? Thank You

Re: Choice of Visitation by a Teenager

You can certainly call the police or constable when the father appears for his next visitation. Be sure to have a certified copy of the last court document the judge signed that states the visitation periods the father has with his child.

Be advised, however, that on Friday nights on the first, third and fifth of each month, the police and constables are receiving lots of phone calls. They can only handle a limited number of them.

I don't know if the officer will make a 17 year old leave against her wishes.

Of course, you are certainly free to try to get her to come with you.

Good luck!
