Legal Question in Family Law in Texas

claiming estate of a will

My husband died 9 years ago and his dad died 5 yrs. ago. He had him in the will as one of the 5 children to receive part of his estate or his beneficiaries or survivors. I acquired the will but never did anything about it because I thought that since my husband died before his father that my children or I could not do anything about this. Do I or my children have a right to part of that and is too late to do anything about it?

Re: claiming estate of a will

It's hard to tell exactly what you mean by 'acquired the will'. If your father-in-law's estate has already been probated it's probably too late to do anything. If it hasn't, it's too late to probate the Will, but not too late to settle the estate. You really need to talk to a good probate attorney.
