Legal Question in Family Law in Texas
clause in court order subject to small claims court
My ex has taken several school related items from our daughter during visitation. he refuses to give it back. She needs them for school. (some of the items - jacket, school clothes, jazz shoes for dance, and lunch box) Is it possible for me to take him to small claims court for reimbursement of these items if he still refuses to send them back, as ordered in our decree?

Probably the JP will tell you that the District Court that issued the decree retains continuing jurisdiction of the case, and any complaints must be addressed in that court.
Since the items are not expensive enough to justify attorney fees, it might be worth your while to start by writing a letter to him or to his atty asking that the items be returned or you will file for contempt and ask for costs and attorney fees. It might work.
