Legal Question in Family Law in Texas

Collecting back child support, not court ordered

I was divorced in 2001 Jan. At the time I was living in NM. my son at the time was 10 and he wanted to finish the school year out and live with my Mother. So I agreed. In our divorce decree, it states that his father would have custody or until my son ask to live with one or the other parent, at age 11(and by Kansas they say they are old enough to decide at age 10) he was 11 and came to live with my new husband and I, in Corpus Christi Tx. I verbally ask his dad to help with the support of at least 100.00 a month, he said yes but we never received help with his support. My son lived with us (4 yrs) up until this year and since we have moved here to Oklahoma for my husbands work, my son decided to go stay at his dad's house (in Kansas) and go to school there since that school was much smaller than the one here which is a 6a school. So all that being said is there anyway to collect back child support? Although it wasn't court ordered?

Thank you

Re: Collecting back child support, not court ordered

Probably not.

Since none was ordered, your ex would argue that it was agreed that you were both paying his bills, in a joint and equal manner. Additionally, he will argue that it was a wash against the time the child was with him, and with your Mother.
