College tuition

My husband's divorce decree states that child support stops when the children are 18. Are we required by law to pay for their college tuition?

My best recommendation to you is to consult with an experienced lawyer in Family Law to let him or her examine the specific language in the divorce decree. However, generally speaking, the Texas Family Code Section 154.001 requires people to pay child support for every child under their obligation, either until such child (1) reaches the age of 18; or (2) age 21 if such child is still in High School; or (3) until the child is emancipated through marriage; or (4) until the death of the child; or (5) if the child is disabled, the obligation continues for an indefinite period. Therefore, only based on the above, I would like to say that your husband is not required by law to pay for his children�s college tuition. However, I would reserve a final answer until I read the specific language in your husband�s divorce decree.
