Legal Question in Family Law in Texas

Common law divorce

I have two children with a man I have

been living with for 5 years. We were

not considered common law because

he was still legally married with

someone else. I seeked an attorny in

June 2007 because I did not now if I

had any rights. According to the

attorny I did not, except child support.

In June of 2008 I returned. We have

been living together with our children.

He is not legally married since my

arrival. My question is do I have any

rights? We have one house we rent

out under both of our names. We

have a joint bank account. 1 car

under my name and two cars under his

name that were purchased this year.

The house we are living in was built

together during in 2003; but he put it

under his parents name, but their is

proof that he makes the payments.

He also has. Several businesses.

I just want what is in the best

interest of my children.
