Common Law to Formal Marriage
If a couple who are in a common law marriage recognized by the state of Texas, moves to Minnesota and decides to formalize their marriage, would they first need to obtain a divorce?

There is no need for a divorce because of Texas law.
Not all states recognize common law marriages, whether registered or not. However, as a general rule, a marriage that is valid in the state where it was performed is considered valid by other states.
It would be wise to consult a lawyer because there may be other isues that should be handled.
