Legal Question in Family Law in Texas

Common Law?

A freind of mine has a girlfreind for about 5 yrs. A home togather in both their names, a car in his name that she drives, and he wishes to end the relationship due to some infidelities and other problems. In Texas what is concidered common law marriage, and what does he need to do to end it? Does he need to file for divorce like any other marriage, or is common law handled differently? Also I must add that she has no job and he has been paying all the bills for some time. He has asked me to find these things out because she would make it very hard on him if she found out yet. She will probably try to fight anything he does, so we need to know his legal right before he can move on.With him being on the house note also, he does'nt want to just leave, She would trash his credit. Please help any way you can. I know he's tired of the whole situation, but does'nt know what to do. Thank you!

Unfortunately, you did not give me enough information to answer your questions regarding common law marriage.

Did he/she sign anything as husband and wife -- taxes, car insurance, etc.
