Legal Question in Family Law in Texas

If Ive been with my common law husband 10 years and he claimed my children at tax time twice. Promised marraige, called me his wife. And claimed me as his grandchildren's grandmother to CPS who were going to take his kids away from his son. Do I have a way to not walk away with nothing? I took in his grandbabies while my spouse was overseas and in the process I lost a good job with good pay and benefits. I loved my job. When kids are in the CPS system I was unable to leave kids with anyone until a background check was done and had very little help, not enough to keep my full time job. It is not fair that I leave with nothing and he has a house that will be paid off in ten years. An my name is not on the house.

Leave him, file for divorce, and ask for half of everything.
