common law marrage with children,

I would like to get custody of my children. My Ex is tring to get child support from me. I have been told that we didn't have to get a divorce. I don't want anything from the man. Just want my children.

If you were commonlaw married, and one of the parties initiates legal action within 2 years of the date of separation, then a divorce is necessary. You need to take the particulars of your situation to an attorney for specific advice. If your husband is trying to get custody, you need to be represented by an attorney, as it is NOT a DIY type of proceeding. Good luck.
