There are 3 elements to establishing a common law marriage. First you need an agreemnet between the parties that they consider themselves married (usually a swearing match in most contested cases), next you need cohabitation (but this is not conclusive since there are many unmarried people who may be cohabitating but do not consider themselves married) and most important you need to have held yourself out to the public at large that you are married (this can be established in a number of different ways).
