Legal Question in Family Law in Texas

common law marriage

My girlfriend of three and a half years and I are seperating. She has a child from a previous marriage, and we have a child together. I bought our house in August of 2004. Her divorce was final in March of 2006. We have lived together since 2003. Is it possible that we fall under the catagory of common law marriage? If so, what are my rights for the house and kids. Every thing involved with the house is in my name, and my son has my last name.

You can only be married to one person at a time. If her divorce was final March, 2006, then perhaps you are common law married since her divorce.

Even if you are not married, if you purchased the house in both names, you need to divide your assets.

You need to establish visitation and child support for your child.
